Indieffusione – Terms and Conditions of Use and Community Guidelines
1. Purpose and Scope
The Indieffusione platform (“Platform”) is operated by Noise Symphony and allows artists to register free of charge, submit their music, and take part in promotional, distribution, feedback, and community initiatives. These Terms and Conditions (“T&C”) govern the use of the Platform by registered users, as well as participation in the promoted activities (24/7 radio, interviews, playlists, charts, etc.). By creating an account or participating in any initiative, the user accepts these T&C and any Community Guidelines published on the site.
2. Registration and Account
Registration must be completed using truthful and complete information. Users are responsible for keeping their credentials safe. Registering multiple accounts in order to manipulate metrics, charts, or selections is strictly prohibited. Noise Symphony / Indieffusione reserve the right to verify a user’s identity and to suspend or close accounts in the event of violations.
3. Uploaded Content
The artist warrants that they own or hold a valid licence for all rights to the materials they upload. Content that infringes third-party rights or violates the Community Guidelines is not permitted. Users agree that uploaded materials may be used within Indieffusione initiatives, within the limits defined at the time of participation.
4. Selection and Participation in Initiatives
Participation is subject to internal selection criteria that take into account talent, originality, consistency with the project, and level of commitment. Selection does not constitute a guarantee of commercial results, but an opportunity for visibility and support. Indieffusione may exclude an artist in the event of violations of these T&C.
5. Use of the Community and Conduct
The community is based on mutual respect, quality, and collective growth. Insulting, harassing, spamming, or advertising unauthorised external services is strictly prohibited. Behaviour contrary to the Community Guidelines may result in suspension or exclusion.
6. Intellectual Property and Licence
The artist retains ownership of their materials. By participating, they grant Indieffusione a non-exclusive, worldwide, and time-limited licence for the promotional use of those materials. Indieffusione does not acquire exclusive rights or commercial distribution rights beyond those explicitly agreed upon.
7. Economic Terms
Registration and participation are free of charge. Paid services (promotion, consultancy, distribution) are offered separately and governed by specific contracts. Indieffusione does not guarantee economic returns, but opportunities and visibility.
8. Liability and Limitations
The artist is responsible for their own content and for the consequences arising from its use. Indieffusione and Noise Symphony are not liable for indirect losses or damages resulting from the use of the Platform. Indieffusione reserves the right to modify or suspend activities at any time.
9. Amendments to the Terms
Indieffusione may amend these T&C for legal, technical, or operational reasons. Changes will be communicated via the Platform or by email. Continued use of the Platform after notification implies acceptance of the changes.
10. Termination
Users may close their account at any time. Indieffusione may suspend or close an account for violation of the T&C. Upon closure, materials will no longer be used for new promotions, unless specific agreements have been made.
11. Governing Law and Jurisdiction
These Terms and Conditions are governed by Italian law. Any disputes shall be subject to the jurisdiction of the court at the registered office of Noise Symphony, unless otherwise agreed.
Community Guidelines
Indieffusione promotes a community based on respect and collaboration. Content or behaviour that incites hatred, discrimination, violence, or exploitation is not permitted. Spam, aggressive self-promotion, trolling, or attempts to manipulate metrics are prohibited. Users must respect diversity, contribute constructively, and use appropriate language. Violations of these guidelines may result in warnings, suspension, or exclusion from the community.
12. Use of Images, Logos, and Artistic Data
Indieffusione may use the artist name, images, logos, cover artwork, and other graphic materials provided by artists solely for promotional purposes related to its editorial, radio, and digital activities. This includes use on official websites and social channels, in playlists, in magazine articles, and in Indieffusione’s communication materials. Such use shall be considered non-exclusive and free of charge, limited to the duration of the promotion of the track or the active presence on the platform.
13. Limits on Redistribution
Content uploaded by users may not be transferred, resold, or redistributed to third parties by Indieffusione, unless the artist has given express written authorisation or a specific contractual agreement has been reached. Indieffusione may, however, share materials within its own promotional activities and partnerships without direct commercial gain, in compliance with copyright and the artists’ image rights.
14. Indemnification
The user agrees to indemnify and hold harmless Indieffusione, Noise Symphony, its collaborators, and partners from any claim, demand, damage, or liability arising from infringement of third-party rights, unlawful use of uploaded content, or non-compliance with these Terms and Conditions. The artist remains fully responsible for the accuracy and legality of the materials provided and for compliance with applicable copyright and commercial communications regulations.
15. Duration of the Promotional Licence
The licence granted to Indieffusione for the promotional use of uploaded materials lasts for the period during which the track or the artist’s profile remains active on the platform or included in editorial initiatives. In the absence of written revocation by the artist, the licence is automatically renewed on a yearly basis. The artist may revoke the authorisation at any time, with effect within 30 days of written notice, without prejudice to use already made in materials prior to the revocation.
16. Final Provisions
For all matters not expressly covered by these Terms and Conditions, the provisions of the Italian Civil Code and current Italian legislation on copyright, commercial communications, and personal data processing (GDPR) shall apply. These Terms and Conditions govern the use of the Indieffusione platform, owned by Noise Symphony S.r.l., headquartered in Rome. Accessing and using the platform implies full acceptance of these Terms, as well as the Community Guidelines, which form an integral part of this document. The Community Guidelines, published on the official Indieffusione website, are an integral part of these Terms and Conditions.
